This End User License Agreement ("Agreement") is a legal agreement between you and Bit 0100 Bit Software LLC ("Developer") for the application CAD QuickLook ("Application"). By downloading or using the Application you agree to this Agreement. This Agreement is between you and Developer only, and not with Apple; Developer, not Apple, is solely responsible for the Application and its content.
Developer grants you a non-transferable license to use the Application on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules. Except as set out in Section 9 (Open-Source Components), you may not distribute or make the Application available over a network where it could be used by multiple devices at once, and you may not copy (except as the license permits), decompile, reverse-engineer, disassemble, or modify the Application.
Developer is solely responsible for any maintenance and support for the Application as specified in this Agreement or required by law. Apple has no obligation to provide any maintenance or support.
Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are Developer's responsibility.
Developer, not Apple, is responsible for addressing any claims by you or a third party relating to the Application or your possession and/or use of it, including product-liability, legal/regulatory-compliance, and consumer-protection claims.
If a third party claims the Application infringes its intellectual property, Developer (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government prohibited or restricted-parties list.
You must comply with applicable third-party terms when using the Application (see Section 9).
Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce it against you.
